Many employees are unaware of certain requirements that must be met prior to filing a charge or claim under Title VII, ADEA or the Equal Pay Act. Generally speaking, in order for an employee to be able to present a charge or claim for sexual harassment, disability discrimination, pregnancy discrimination or race and color discrimination, that employee must be employed by an employer who employs at least 15 individuals. The Family Medical Leave Act requires there to be at least 50 employees for an employee to come with the coverage of that law.
For age discrimination claims and employee needs to establish that he or she worked for an employer who employed at least 20 individuals.
The claims above must be presented to the Equal Employment Opportunity Commission by filing a charge of discrimination within 180 days of the improper conduct. The necessary forms are available on the EEOC website or you can contact our office for help completing them.
