Treating an applicant or employee unfavorably because he or she is of a certain race, or because of personal characteristics associated with his or her race is a violation of the Civil Rights Act of 1964, which was enacted to prevent race or color discrimination within the workplace. Race or color discrimination can occur when an employee suffers adverse treatment from his or her employer because of his or her skin color, dress, facial features, native language, or accent.
The law forbids race or color discrimination when it comes to any aspect of employment. No employee should suffer the loss of his or her job, a difference in pay or job assignment. The law further protects from promotions, layoff, training, fringe benefits, or any other term or condition of employment being based on race or color discrimination. Title VII of the Civil Rights Act of 1964 does not allow an employee to condone or allow racially motivated decisions.
